2.0 PUBLIC COMMENTS

At this time, the public is permitted to address the City Council/Redevelopment Agency/Public Financing Authority on non-agendized items. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, however, no action or discussion may take place on any item not appearing on the posted agenda. The City Council/Redevelopment Agency/Public Financing Authority may respond to statements made or questions asked or may request Staff to report back at a future meeting on the matter. The exceptions under which the City Council/Redevelopment Agency/Public Financing Authority MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code §54954.2(b)(1)(2)(3). Members of the public should submit any Speaker Cards for Public Comments in advance of the Mayor/Chair calling for Public Comments.

Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council/Redevelopment Agency/Public Financing Authority with one single action. Members of the audience, Staff or the City Council/Redevelopment Agency/Public Financing Authority who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor/Chair remove the item. Request for approval of amendments to the Development Agreement by and between the City of Oakley and the Lesher Trust, which was entered into in October of 2005, relating to the project known as Lesher Trust Property. Proposed amendments would extend the term of the agreement to 2025 and update language to reflect that the property is within City limits and a part of the approved East Cypress Corridor Specific Plan. APNs 032-082-005, 032-082-007.

4.2 Biggs Subdivision 9156 (Bethel Island, LLC.) Development Agreement (DA 02-11) (Ken Strelo, Senior Planner)

Request for approval of a 20-year development agreement by and between the City of Oakley and Bethel Island, LLC. relating to the project known as Bethel Island, LLC, Planning Area 4 of the East Cypress Corridor Specific Plan (also known as Biggs Subdivision 9156). A vesting tentative map was approved for the project site on November 8, 2011. The project area is located south of the existing Summer Lake South Subdivision located in the East Cypress Corridor Specific Plan Area. APNs 020-140-007 and 020-150-003.

Request for approval of a 20-year development agreement by and between the City of Oakley and Pacific West Communities, Inc. relating to the project known as “Planning Area 6-H” of the East Cypress Corridor Specific Plan. The project area is located along the west side of Bethel Island Road, approximately 1 mile north of East Cypress Road. The project is located in the East Cypress Corridor Specific Plan Area. APNs 032-082-010 and 032-082-011.
